In Delaware County Court on Jan. 5:

ä A Smithville Flats man pleaded guilty to second-degree criminal possession of a controlled substance for possessing eight or more ounces of cocaine in Deposit on June 17.

Richard M. Carbone, 54, will be sentenced Feb. 8 to five years in prison and will forfeit a 2001 Nissan Frontier valued at $1,200.

ä Robert N. Utter, 55, of Franklin, pleaded innocent to first-degree aggravated unlicensed operation, driving with ability impaired by alcohol, no license plate, no insurance and unregistered motor vehicle.

Utter was released on $500 bail, and his trial was scheduled for the April 27 term.

In court on Monday:

ä Christopher Yeary, 30, of Hamden, was sentenced to one year in jail and fined $3,000 for a DWI charge stemming from an incident Sept. 21 on Orchard Street in Delhi.
