Judge sets bail for five facing drug charges

DELHI _ Five of the six Walton residents accused of selling prescription drugs appeared in Delaware County Court on Monday with assigned attorneys to have bail set.

They were arraigned last week.

The individuals arrested, the charges and the bail are:

ä Kenneth Rocher, 49, two counts of third-degree criminal sale of a controlled substance for allegedly selling morphine Oct. 16 and Oct. 27, and one count of fourth-degree criminal sale of a controlled substance for allegedly selling methadone Nov. 2. Rocher is represented by Andrew VanBuren, and bail is $30,000 cash or $60,000 bond.

ä Shaun L. Provost, 30, one count of third-degree criminal sale of a controlled substance for allegedly selling oxycodone Dec. 23, and two counts of fourth-degree criminal sale of a controlled substance for allegedly selling dihydrocodeinone Oct. 28 and methadone Nov. 13. Larisa Obolensky is Provost's attorney, and his bail is $10,000 cash or $20,000 bond.

ä Sarah C. Roe, 38, one count of third-degree criminal sale of a controlled substance for allegedly selling morphine Nov. 11, two counts of fourth-degree criminal sale of a controlled substance for allegedly selling dihydrocodeinone Nov. 15 and 17, and endangering the welfare of a child Nov. 9. Roe's attorney is Marybeth Dumont, and Roe's bail is $20,000 cash or $40,000 bond.

ä John Tallarico, 40, two counts of third-degree criminal sale of a controlled substance for allegedly selling oxycodone Dec. 8 and 9, and one count of fourth-degree criminal sale of a controlled substance for allegedly selling dihydrocodeinone Dec. 9. Tallarico is represented by Gregory Kottmeier; his bail is $10,000 cash or $20,000 bond.

ä Kevin J. McNulty, 46, one count of fourth-degree criminal sale of a controlled substance for allegedly selling dihydrocodeinone Nov. 10. Robert Gouldin is assigned to represent McNulty, who is remanded without bail.

District Attorney Richard Northrup said the third-degree charges carry maximum sentences of nine years each in prison, and the fourth-degree charges carry maximum sentences of seven years each. He said the sentences for each charge could run consecutively.

Delaware County Judge Carl Becker previously entered pleas of innocent for each of the defendants.

All of the sales were allegedly made in the village of Walton, according to court records.

Walton Police Chief Dave Halaquist said the prescription drugs were all legally obtained by the individuals involved. He said in most cases they obtained prescriptions and filled them using insurance, Medicaid or Medicare.

Donald R. Covey did not appear, and Northrup said he did not have any information on the case Monday. Covey, 52, was arraigned last week on four counts of third-degree criminal sale of a controlled substance for allegedly selling morphine Oct. 28 and 30 and Nov. 1 and 27.
