Walton man pleads guilty to DWI

DELHI _ Two cases involving driving under the influence were heard in Delaware County Court on Monday.

Kenny E. Coss, 46, of Walton, pleaded guilty to driving while intoxicated on Oct. 18 in Delhi in a plea agreement in which he was sentenced to a year of weekends in jail and a $1,000 fine.

On Oct. 9, Coss had been sentenced on a misdemeanor DWI charge in Walton Village Court.

Coss said he was driving home from John's Tavern in Stamford when he was stopped near Fitches Bridge on Back River Road in Delhi.

Delaware County Judge Carl Becker told Coss he has a serious drinking problem, and said he should refrain from consuming alcohol.

"It was probably not the smartest thing to do to show up here (in court) in a sweatshirt with an alcohol logo," Becker said.

Coss was wearing a blue sweatshirt with a Guinness logo.

In anther case, Karen E. Miller, 48, of Stamford, was arraigned on charges of felony driving while ability impaired by drugs and a misdemeanor DWI count.

Miller pleaded innocent and was released on her own recognizance to await trial Jan. 4.

Miller's charges stem from an alleged incident Jan. 16 in the village of Stamford.

In county court on July 6, two cases involving violation of probation were heard:

ä Frank Casey, 43, of Arkville, pleaded guilty to violating his probation by being charged with third-degree menacing and three counts of endangering the welfare of a child, and was sentenced to 1 1/3-to-4 years in prison.

Casey had been resentenced to probation June 15 for possessing and using marijuana and cocaine on several occasions. He was released to seek inpatient substance-abuse treatment, but on the ride home, he assaulted his wife while still in the village of Delhi.

Casey was originally sentenced to five years' probation on April 23, 2008, on a second-degree assault charge.

ä In another case, Samantha Roupp, 22, of Jefferson, appeared in court for a violation of probation hearing after being arrested May 9 on two felony charges of third-degree criminal possession of a controlled substance.

Roupp's attorney, Andrew VanBuren, requested an additional hearing on the reasons for the traffic stop that resulted in the charges.

Roupp was arrested by the Delaware County Drug Enforcement Unit, which included members of the county sheriff's office, county probation department, county special-investigations unit and state police.

Deputies said that at the traffic stop on state Highway 23, Roupp was found to be in possession of 15 baggies of cocaine, packaged for resale, with a total weight of about 12 grams.

During a search of her residence, deputies discovered about 38 grams of powder cocaine. More than $1,600 in cash was also seized from Roupp, and her vehicle was impounded.

Roupp was jailed on $50,000 cash bail or $100,000 bond.
