Man gets tougher sentence

DELHI _ A Sidney Center man who pleaded guilty to second-degree rape in Otsego County appeared in Delaware County Court on Monday to be resentenced on a sexual abuse charge.

Brandon M. Reynolds, 21, was sentenced to one-to-three years in state prison. He was given youthful offender status when he was sentenced on July 28, 2004, to probation on the first-degree sexual abuse charge.

Reynolds admitted violating the terms of his probation, which forbid him from associating with individuals younger than 18.

Delaware County Judge Carl Becker said Reynolds had been communicating with two 14-year-old girls by phone and on the computer.

Reynolds' attorney, Robert Gouldin, said that when Reynolds appears for sentencing before Supreme Court Justice Michael Coccoma on Sept. 15 to be sentenced on the rape charge, the sentence will run consecutively with the Delaware County sentence.

According to Otsego County Court records, the rape charge stems from incidents that occurred between Feb. 1 and March 23 in the city of Oneonta and involved a person younger than 15.

In another case, a federal inmate who had been housed temporarily at the Delaware County jail pleaded innocent to intimidating a witness, first-degree assault and second-degree assault.

Taron O. Robinson, 21, was remanded without bail to await trial during the January term.

Robinson and Kamar L. Harrison, both of Albany, are accused of causing serious physical injury to another inmate on Feb. 18.

Delaware County District Attorney Richard Northrup said Harrison and Robinson allegedly broke Yushaa Abdul Abdas-Salam's leg in retribution after Abdas-Salam told a correction officer that one of the two men had punched another inmate. The incident occurred in February.

Harrison was arraigned July 21 on charges of first-degree assault and first-degree intimidating a witness.

In a third case, a man who failed to show up for sentencing May 12 on a driving while intoxicated charge was sentenced to 1 1/3-to-4 years in state prison.

Franklin Baez, 44, of Elmwood Park, N.J., pleaded guilty April 25 to two counts of DWI, first-degree aggravated unlicensed operation, false impersonation, obstructing governmental administration, no seat belt, unlicensed operation and speeding.

Baez originally pleaded guilty in a plea agreement in which he would be sentenced to one year in jail, pay a fine and lose his driver's license.

When Baez didn't show up for sentencing in May, Becker said his plea agreement was "in serious jeopardy." Becker told Baez, "I told you that if you didn't show up things would go very harshly for you and you didn't show up."

Becker said Baez has been arrested more than 30 times and has multiple convictions.

"Your rap sheet is literally longer than my arm," Becker said. "It is time for you to take responsibility for your criminal conduct."

Becker also fined Baez $10,750.

In other court business:

ä Brandon Sickler, 18, of Franklin, pleaded guilty to a reduced charge of second-degree attempted burglary in a plea agreement in which he will be sentenced to five years of probation, will make restitution and will get youthful offender status.

Sickler was also ordered not to have any contact with Matthew Woodard or Calynne Johnson.

According to court records, Sickler allegedly entered a dwelling at 482 Main St. in Franklin with the intent to commit larceny. He was ordered to stay away from Matthew Edwards, the clerk at the Franklin Quickway.

Sickler was released on his own recognizance. His sentencing is scheduled for Sept. 8.

ä A Walton woman who pleaded guilty on May 7, 2007, to forging a doctor's prescription to purchase narcotics appeared in court and was sentenced to a year in jail for violating her probation.

Nicole R. Holden, 29, admitted possessing and using marijuana.

Last year, Holden pleaded guilty to second-degree criminal possession of a forged instrument. She admitted to having a forged prescription for Soma, a muscle relaxant, using the illegally obtained forms to buy drugs at pharmacies in Walton and Delhi.

At the time, Becker sentenced Holden to five years' probation and ordered her to pay restitution totaling $6,255.95.
