A felony insurance fraud case involving an Otego couple was heard in a local court last week without resolution, the prosecuting attorney said Wednesday.

Otsego County Assistant District Attorney Michael Getman said he met with Gar Gozigan, defense attorney for Donald F. Brown, 64, and Gretchen E. Monser, 49, of 180 Farone Road in Otego, on Thursday with a judge, but no disposition was reached.

Getman said he would recommend to District Attorney John Muehl that the case be presented to a grand jury.

Brown and Monser were charged earlier this year by the Frauds Bureau of the state Insurance Department with first-degree falsifying business records and fourth-degree insurance fraud. Getman said the defendants have entered a not-guilty plea.

Brown and Monser are accused of filing a false claim for living expenses with the Broome Cooperative Insurance Co., a spokesman for the state Insurance Department said, and they submitted a claim for a $1,700 rental agreement that allegedly was false and inflated.

A fire of unknown cause and origin destroyed their house March 21, officials said previously, and there wasn't evidence the blaze was incendiary.
