Ex-kennel owner faces misdemeanor charges

---- — A Schenectady man has been arrested on two misdemeanor charges in connection with the sale of a puppy, state police at Oneonta said.

Frank M. Popolizio, 67, was charged Tuesday with offering a false instrument for filing and petit larceny, troopers said.

He is accused of providing false information on a state Agriculture and Markets document pertaining to the sale of a dog, troopers said. The complainant in a report initiated in November told troopers he bought a vizsla puppy for $1,095, plus $150 for the pick of the litter. A trip to a veterinarian resulted in the identification of medical issues for the puppy, troopers said.

The petit larceny charge stems from a bounced check for $150 that Popolizio wrote to the complainant, troopers said.

In October, Popolizio pleaded guilty in Otsego County Court to grand larceny on charges he ripped off vendors and customers. The plea, which was made on the second day of a trial, called for restitution and five years of probation in which Popolizio was prohibited from owning animals.

Popolizio’s plea also was in satisfaction of multiple misdemeanor counts of animal cruelty in connection with underfed dogs that were seized from his kennel, South Side Dogs, in Worcester, by troopers in January 2012.
