Three men charged with felony heroin sale

---- — A local college student and two Bronx men were in Otsego County jail Wednesday night on charges of felony possession of heroin with intent to sell, authorities said.

Oneonta city police arrested the men Tuesday night and seized 409 bags of heroin, worth about $8,000, plus packaging materials, $2,992 in cash, 5.8 grams of marijuana, a .22 Ruger rifle, two hydrocodone pills and two hypodermic needles.

Police charged David A. Kohls, 21, of Oneonta, Terell S. Hardy, 37, and Jose M. Gonzalez, 20, both of the Bronx, with third-degree possession of a controlled substance with intent to sell, police said in a media release.

Officers responded to a reported fight at 40 Maple St. at about 8:30 p.m. Tuesday but found the incident had ended, the release said. An investigation revealed that the altercation may have been drug-related, police said.

Lt. Douglas Brenner said the presence of drugs and a weapon is a dangerous combination. The rifle hadn’t been stolen, he said, and police continue an investigation to identify its owner.

Kohls, a student at the State University College at Oneonta, lives at 40 Maple St., police said, and the Bronx men were visiting.

The three defendants were arraigned before Oneonta City Court Judge Lucy Bernier and sent to Otsego County jail. Bail was set at $25,000 bail for Kohls and $30,000 each for Hardy and Gonzalez, according to the release. 

The felony third-degree criminal possession of a controlled substance charge could result in a sentence of up to nine years in prison, police said.

Brenner said responding police were officers Jeffrey Gallusser, Jennifer Imperato and Brian Cetnar and Detective Eric Berger.
