Pacherille sues Otsego district attorney, others

Anthony Pacherille Sr. has filed a civil suit for violation of his civil rights, according to a complaint filed in United States District Court Northern District of New York.

The court filing dated Oct. 16 lists Otsego County District Attorney John Muehl, Otsego County Sheriff’s Department Senior Investigator Miche Ten Eyck and Craig Lippitt as defendants.

The charges follow actions after the April 29, 2011, guilty plea of the plaintiff’s son, Anthony Pacherille Jr., for attempted murder in the shooting of Wesley Lippitt, Craig Lippitt’s son.

Pacherille was sentenced to 11 years in prison.

Ten Eyck executed a search warrant at the Pacherille home July 14, 2011, at the urging of Muehl and Lippitt. Muehl in concert with Lippitt brought various charges again Pacherille. He was convicted of consolidated harassment charges, and other counts were dismissed May 2013, the complaint said.

The complaint states that the three defendants should have known their actions “violated clearly established law protecting the constitutional and statutory rights “ of Pacherille.

As a result he suffered mental, physical and emotional trauma and pain and suffering. This has caused psychiatric issues that forced Pacherille to leave Cooperstown and move to another village, the complaint said. He has been unable to sell his Cooperstown residence and had to go to foreclosure, causing irreparable financial damage, the complaint said.

The suit seeks a total of $8 million in damages from each of the defendants.

Pacherille referred questions to his attorney Frank Policelli, who said the case could go to trial in 2015.
