A recent letter to The Daily Star complained about a decision by the Richfield Town Board, without acknowledging the letter-writer’s full role.
Richfield has approved a windmill project that the writer is trying to stop. She initiated a lawsuit, currently in litigation and subsequently urged the town board to adopt a broad moratorium on all “industrial” land use in the town.
Ms. Frigault’s lawsuit has stopped the windmills for now, but why should Richfield ban all industry? What’s next? No large soft drinks?
Richfield was right to reject the moratorium. As one board member said at the meeting, proponents failed to identify a “dire emergency.” This is the proper standard. State Supreme Court Justice Ferris D. Lebous struck down a Binghamton moratorium last month, declaring: “First, there has been no showing of dire need ...”
In voting down the moratorium, the Richfield Town Board stands on the right side of the law.
