He had been scheduled to stand trial separately on multiple misdemeanor counts of animal cruelty, but his guilty plea to the felony grand larceny count was accepted in satisfaction of those charges, Muehl said.

Popolizio was convicted last year of third-degree criminal tax fraud after failing to pay state sales taxes on receipts from a now-closed restaurant he ran in Schenectady.

While some would argue he should have served time in jail, a man who would cheat nuns and the government, and is accused of mistreating animals, needs to pay the price. The agreement ensures he is punished for the crimes.

State Supreme Court Judge George Ceresia stated the State Office of Parks, Recreation and Historic Preservation “extended their reach beyond inter-interstitial rulemaking and into the realm of legislating” when it instituted the policy.

The Parks Department is considering an appeal. We encourage the appeal, and urge state lawmakers to enact a law that creates no-smoking areas in all parks.
