Federal Alcohol, Tobacco and Firearms agents executed a search warrant last week and seized the inventory of a gun shop in Davenport, a federal attorney said Tuesday.
No arrests have been made in the pending investigation of Lyn’s Leisure Tyme Gun Shop, Robert Sharpe, an assistant U.S.attorney in Albany for the Northern District of New York, said. The ATF, armed with a federal search warrant, seized an undisclosed quantity of guns and ammunition from Lyn’s Leisure Tyme on Thursday, he said.
Linda Fitzpatrick is the registered and licensed owner of Lyn’s Leisure Tyme, Sharpe said. She has operated the business since 1991, he said, and the shop has been in its current location since 2006.
A message left Tuesday afternoon at the telephone number for Lyn’s Leisure Tyme, 15849 State Route 23 in Davenport, wasn’t returned.
Sharpe said Fitzpatrick’s husband, Hadley, is prohibited under federal law from buying and selling firearms, but the attorney wouldn’t comment on reasons for the prohibition because of the sealed warrant.
The Bureau of Alcohol, Tobacco, Firearms and Explosives is part of the U.S. Department of Justice.
The Fitzpatricks previously were involved in a similar situation with authorities, Sharpe said.
According to an agreement with the ATF in 2007, Hadley Fitzpatrick wasn’t allowed to buy or sell firearms at Lyn’s Leisure Tyme, Sharpe said. The couple complied for a time, he said, but authorities later received information that Hadley Fitzpatrick again was buying and selling guns.
Sharpe said the warrant, which remains sealed, was issued based on information that Hadley Fitzpatrick was buying and selling firearms at his wife’s gun shop.
Citing the sealed status of the warrant, Sharpe refused to disclose the quantity of firearms and ammunition seized Thursday.
Sharpe said he didn’t know when the warrant would be unsealed or the next step in the case, though potential exists that federal authorities could look into filing charges.
Delaware County Undersheriff Craig DuMond said deputies were notified about the ATF case and were present at the scene Thursday.
